AI Regulation entered into force

Who it affects: Everyone

The European AI Regulation (Regulation (EU) 2024/1689) formally entered into force on 1 August 2024. From this date the phased application of the obligations started. Most provisions only apply from later dates.

Prohibited AI practices (Article 5) and AI literacy (Article 4) apply

Who it affects: All organisations using AI

Since 2 February 2025 the prohibited AI practices of Article 5 apply, including social scoring and certain forms of manipulative AI. Article 4 applies at the same time: organisations ensure a sufficient level of AI literacy among staff working with AI. Both obligations apply to virtually every organisation using AI.

GPAI obligations for new models and governance structure apply

Who it affects: Model providers and downstream parties

Since 2 August 2025 the obligations apply to providers of general-purpose AI models placed on the market from that date, such as technical documentation and a training data summary. The European governance structure around the AI Office applies from the same moment. Downstream parties building on these models see this through documentation and terms from their provider.

General application date: enforcement and penalties operational, Dutch Implementation Act

Who it affects: Everyone; supervisors gain the power to impose fines

On 2 August 2026 the AI Regulation becomes generally applicable. The enforcement and penalty structure is then operational and in the Netherlands the Implementation Act designates the competent supervisory authorities. From this date supervisors can impose fines for non-compliance.

GPAI models placed on the market before 2 August 2025 must comply

Who it affects: Model providers

Providers of general-purpose AI models already on the market before 2 August 2025 have until 2 August 2027 to meet the GPAI obligations. These include technical documentation, information for downstream parties and a training data summary.

High-risk obligations Annex III take effect (date from the Digital Omnibus agreement, formal adoption pending)

Who it affects: Providers and deployers of Annex III systems

Under the Digital Omnibus agreement the high-risk obligations for Annex III systems take effect on 2 December 2027. Formal adoption of this date is still pending. The obligations include risk management, technical documentation, human oversight and registration for systems in domains such as HR, education and essential services.

High-risk obligations for Annex I products take effect (date from the Digital Omnibus agreement, formal adoption pending)

Who it affects: Manufacturers with AI in regulated products

Under the Digital Omnibus agreement the high-risk obligations for AI in regulated products under Annex I apply from 2 August 2028. Formal adoption of this date is still pending. This affects manufacturers of, for example, machinery, medical devices and vehicles in which AI is used as a safety component.

This date follows the Digital Omnibus agreement; formal adoption is still pending.

Existing high-risk systems of public sector organisations must comply (Article 111)

Who it affects: Public sector organisations

High-risk AI systems already used by public sector organisations before the relevant application dates must comply with the regulation by 2 August 2030 at the latest (Article 111). This gives public bodies a longer transition period for existing systems. An up-to-date algorithm register helps keep these systems in view in time.
