Declaración UE de conformidad La declaración UE de conformidad a que se hace referencia en el artículo 47 contendrá toda la información siguiente:

1. El nombre y tipo del sistema de IA, y toda referencia inequívoca adicional que permita la identificación y trazabilidad del sistema de IA.

2. El nombre y la dirección del proveedor o, en su caso, de su representante autorizado.

3. La afirmación de que la declaración UE de conformidad con el artículo 47 se expide bajo la exclusiva responsabilidad del proveedor.

4. La declaración de que el sistema de IA es conforme con el presente Reglamento y, en su caso, con cualquier otra disposición de Derecho de la Unión pertinente que disponga la expedición de la declaración UE de conformidad con el artículo 47.

5. Cuando un sistema de IA implique el tratamiento de datos personales, la declaración de que el sistema de IA se ajusta al Reglamento (UE) 2016/679, al Reglamento (UE) 2018/1725 y a la Directiva (UE) 2016/680.

6. Referencias a todas las normas armonizadas pertinentes que se hayan aplicado o a cualquier otra especificación común respecto de la que se declara la conformidad.

7. En su caso, el nombre y el número de identificación del organismo notificado, una descripción del procedimiento de evaluación de la conformidad que se haya seguido y la identificación del certificado expedido.

8. El lugar y la fecha de expedición de la declaración, el nombre y el cargo de la persona que la firme, la indicación de la persona en cuyo nombre o por cuya cuenta firma la declaración y la firma.

Do I need to mention a notified body on the declaration of conformity?

Only where applicable. Point 7 requires you to state the name and identification number of the notified body, a description of the conformity assessment procedure performed, and identification of the certificate issued.

Is the declaration of conformity per AI system or per product line?

The declaration is per AI system. Point 1 requires the name, type and any additional unambiguous reference allowing identification and traceability of the specific AI system.

Which standards must I reference in the declaration of conformity?

Point 6 requires references to any relevant harmonised standards or other common specifications in relation to which conformity is declared. These are the same standards referenced in the technical documentation (Annex IV, point 7).

Where do I store the EU declaration of conformity?

Under Article 47(2), the declaration must be available for 10 years after market placement. A copy must also be included in the technical documentation (Annex IV, point 8) and submitted for EU database registration (Annex VIII).
