What does Annex IX of the AI Act regulate?
Annex IX describes the information to be submitted upon registration of high-risk AI systems from Annex III that are tested in real world conditions, in accordance with Article 60.
What information must be registered for real world testing?
There are 5 mandatory data points: (1) a Union-wide unique identification number, (2) name and contact details of provider and involved deployers, (3) description of the AI system and intended purpose, (4) summary of the testing plan, and (5) information on suspension or termination.
Why is registration of real world tests mandatory?
To ensure transparency and oversight. Real world tests with high-risk AI systems may pose risks to involved persons. Registration enables authorities to monitor tests and intervene if necessary.
Do I need to make my testing plan public?
You must register a summary of the main characteristics of the testing plan (point 4). The full plan does not need to be made public but must be available to authorities.
What if I stop a real world test?
Point 5 requires that information on the suspension or termination of the test is registered and kept up to date.
Does Annex IX apply to all AI tests?
No, Annex IX only applies to high-risk AI systems listed in Annex III that are tested in real world conditions under Article 60. Regular tests in controlled environments are not covered.
Who is responsible for registering real world tests?
The provider or prospective provider is responsible for submitting the registration information. Contact details of involved deployers must also be provided.
How do I obtain a unique identification number for the test?
The Union-wide unique identification number is assigned upon registration in the EU database. This number enables the test to be traced and monitored.
